1. When you set up an account. When you create an account, we ask you to provide your first and last name, email address, and a password we can use to authenticate you at sign in. Creating an account allows you to log in on a different or shared device, purchase products, and access your order history.
2. When you make a purchase from our Site. If you choose to purchase products through our Site, you will be required to provide certain information such as your name, payment card details, and billing address in order to facilitate payment. Payments are handled by our third-party partners, including Paypal, Google Pay, Meta Pay, Venmo, Cash App, Apple Pay and Shopify (which hosts our online store). You will also be asked to provide a name, phone number, and shipping address where you’d like us to send your order.
3. When you sign up to receive communications from us, including signing up for emails, newsletters, or SMS updates. When you engage in one of these activities, we may collect your name, mailing address, email address, telephone number, and any additional information you choose to provide to us as part of that request. We use your email address and telephone number to notify you about products and promotions we may offer and provide news and information we believe will be of interest to you.
4. When you take quizzes or surveys. From time to time, we may offer quizzes or surveys on the Site. If you choose to participate in these activities, we may collect a variety of information from you, including your name, contact details, and any other information relevant to that quiz or survey, or which you choose to provide. This can include things like your age, gender, and other demographic data; your general location (city/state); your level of gaming experience, and your interests. We use this information to better understand our customers; to provide personalized product recommendations to you, and to direct you to news and content we believe will be of interest to you.
5. When you contact us. When you contact us by email; through our branded social media accounts, or customer support site; through any integrated chat providers we may offer; or by telephone, SMS, or physical mail, we may collect your name, social media username (if applicable), email address, phone number, physical address, and the contents of your communication which can include any information you choose to provide.
6. When you register for a contest, competition, or sweepstakes. In these circumstances, we may collect your name, contact details, location, photo, demographic information, a short bio, and any other information you choose to provide. In limited situations, we may need to collect additional information for eligibility verification and tax compliance purposes, such as proof that you are over 18 and a U.S. resident. Some of this information may constitute sensitive personal information (or an equivalent term) under certain state laws. We use this information strictly to confirm eligibility and meet our legal obligations.
· Inviting others to try Mercy Gaming or sending a gift card. We may allow you to invite others to try our Site. If you do this or are invited in this way, we will collect and store the invitee’s email address in order to enable us to send an invitation.
Information Collected Automatically When You Use Our Services
Certain information is also collected automatically as you navigate our Services or interact with our communications. For instance, when using our Site, we may collect your Personal Information through the use of cookies, log files, web beacons, tags, pixels or other technology.

2. “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
3. “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.
We may also partner with third parties who provide analytics services and serve advertisements on our behalf across the Internet and in mobile applications. These third parties may use cookies and similar technologies to track your engagement with our Site as well as our online advertising and email marketing campaigns and permit us and them to analyze and track data, and do things like determine which advertising or marketing source brought someone to our Site and target advertisements to an audience based on prior browsing patterns on our Site.
Information We Collect From Other Sources
We may also obtain Personal Information from other sources. For instance, we may collect Personal Information about you from the following third parties:
1. Payment processors. In general, when you purchase products through our Site, your payment card information is provided directly to our third-party payment processing partners, including Paypal, Google Pay, Meta Pay, Venmo, Cash App, Apple Pay, and Shopify, and Mercy Gaming does not collect or store that information. However, we may have access to limited information about your payment card from these partners and related transaction details, such as the last four digits of your card, the country of issuance, and the expiration date.
We may combine the information we collect about you from these various sources. If a combination of information that we collect identifies you as an individual, we will treat the combined information as Personal Information.
4. How Your Personal Information Is Used:
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information:
- For the purposes for which you provided it;
- To communicate with you;
- To process and respond to your inquiries;
- When in line with the preferences you have shared with us, to send you alerts or other communications via SMS messages or other media or networks;
- For internal research and reporting;
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services; and
- To carry out any other purpose described to you at the time the information was collected.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
We may offer you the ability to receive newsletters or marketing periodically by physical mail or email about our products and services, and the products and services of our affiliates. You can stop receiving further newsletters or marketing emails by unsubscribing using the link in the footer of each email we send to you. Note that it may take up to ten (10) days for us to process your request and you may continue receiving promotional emails from us during that period. If you opt out of receiving such communications, please be aware that you will continue to receive non-promotional emails (such as transaction-related emails regarding products and services you have requested or emails related to our business relationship or changes to our legal terms). If you opt-into receiving SMS/MMS marketing messages from us, such programs shall be governed by our Terms of Service. You may opt out of receiving SMS/MMS messages from us by following the instruction in the text message or by contacting us using the information in the “Contact Us” section of this Privacy Notice.
5. Sharing Your Personal Information:
We may share information about you with third parties in the following circumstances:
1. Vendors/Service Providers. We may share your Personal Information with vendors, sponsors, and business partners engaged by us in order to provide you with goods or services you have requested. For instance, we share your Personal Information with Klaviyo Inc. 2. Companies Under Common Control. In addition, please be advised that we may share your Personal Information with our affiliates or subsidiaries, and/or with its respective parent companies, including, without limitation, JVEB, Inc. and HGCO, Inc., for purposes as described above in Section 4 of this Privacy Notice.
3. Advertising and Analytics Partners. We may share your Personal Information with other third parties that provide online analytics and advertising services in order to better understand how individuals interact with our Services and other online services over time and across devices.
4. Public. If you post Personal Information publicly through the Site (for instance, if you provide a review of a product you purchased) it may be viewable by other users of the Site. Please use caution before revealing any information that may identify you in the real world to other users. We cannot prevent further use of any Personal Information that you choose to include in your reviews by other users.
5. Business Transfers. We may share Personal Information with another company in connection with or during negotiations of any merger, acquisition, financing, re-organization, bankruptcy, sale of all or a portion of our assets, or transition of services to another provider.
6. Legal Requirements. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
7. Consent. We may share Personal Information with third parties with your consent and at your direction, including if we notify you that the information you provide will be shared in a particular manner and you provide that information.
8. Aggregate/De-identified Information. We may also share aggregate or de-identified information, which cannot reasonably be used to identify you, for various purposes including compliance with various reporting obligations; for business or marketing purposes; or to assist third parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Services.
6. Behavioral Advertising:
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 7. Our “Do Not Track” Policy:
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser. 8. Accessing, Updating, and Deleting Your Account Information:
If you are a customer, you can access, update, and delete certain Personal Information associated with your account in your account settings. Please note that if you choose to close your account, we may keep certain Personal Information as necessary to comply with our legal obligations or for legitimate business purposes, such as to resolve disputes or enforce our agreements. 9. Additional Rights for Residents Outside of the United States:
If you are a European Economic Area (“EEA”), United Kingdom, or Switzerland resident, you may have additional rights including the following:
1. Role. Mercy Gaming is considered the “data controller” of the Personal Information that we handle under this Privacy Notice. Our full contact details can be found in the “Contact Us” section of this Privacy Notice.
2. Purposes of processing and legal basis for processing: Data protection laws in the EEA, United Kingdom, and Switzerland require businesses to tell you about the legal grounds they rely on to use or disclose your Personal Information. To the extent those laws apply, we process Personal Information on the following legal bases: (1) with your consent; (2) as necessary to perform our agreement to provide services; (3) as necessary to comply with a legal obligation to which we are subject; and (4) as necessary for our legitimate interests in providing the services where those interests do not override your fundamental rights and freedom related to data privacy.
3. Right to lodge a complaint: Individuals that reside in the EEA, United Kingdom or Switzerland have the right pursuant to the General Data Protection Regulation (“GDPR”) (or its equivalent in the United Kingdom and Switzerland) to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. 4. Cross-border Transfers: Information we collect may be transferred to, and stored and processed in, the United States or any other country in which we or our affiliates or subcontractors maintain facilities. We will ensure that transfers of Personal Information to a third-party country or an international organization are subject to appropriate safeguards as described in Article 46 of the GDPR.
5. Individual Rights: If you are a resident of the EEA, United Kingdom or Switzerland, you are entitled to the following rights. Please note: In order to verify your identity, we may require you to provide us with Personal Information prior to accessing any records containing information about you.
6. The right to request access to your Personal Information. You have the right to access the Personal Information we collect from you. Whenever made possible, you can access your Personal Information by contacting us in accordance with the Contact Us section of this Privacy Notice. This right also enables you to receive a copy of your data.
7. The right to request data correction. You have the right to have any incomplete or inaccurate information we collect from you corrected by us.
8. The right to request data erasure. You have the right to have your Personal Information erased from our Services if the data is no longer necessary for the purpose for which it was collected, you withdraw consent and no other legal basis for processing exists, or your fundamental rights to data privacy and protection outweigh our legitimate interest in continuing the processing.
9. The right to request data transfer. We will provide to you, or to a third-party you select, the Personal Information we collect from you in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
10. The right to restrict or object to our processing. You have the right to restrict or object to our processing if we are processing your Personal Information based on legitimate interests or the performance of a task in the public interest as an exercise of official authority (including profiling); using your Personal Information for direct marketing (including profiling); or processing your Personal Information for purposes of scientific or historical research and statistics.
11. The right to withdraw your consent. You have the right to withdraw your consent to us using your Personal Information. If you withdraw your consent, we may not be able to provide you with access to certain specific functionalities of the Site or Services.
Additionally, if you are a visitor to our websites or other online products and services from outside the U.S., please note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Sites), or otherwise to pursue our legitimate business interests described above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States. 5. Selling and Sharing Personal Information: While Mercy Gaming does not sell Personal Information in exchange for any money consideration, we may receive services or a discount in exchange for some Personal Information collected online which may constitute a “sale” or “sharing” as those terms are defined under California law. For instance, in the last 12 months, we “sold” data about users’ IP addresses and device identifiers and their usage of our Services to third-party analytics and advertising vendors who may use this data to provide them with tailored advertising and for their own purposes.
6. Right to Opt Out of Selling and Sharing: You have the right to direct Mercy Gaming not to sell or share your Personal Information. You can exercise this right by clicking the “Do Not Sell My Personal Information” link at the bottom of our website or clicking here and selecting your preferences or by using the Global Privacy Control (GPC). If you notify us of your preference through GPC, we will honor your requests with respect to the browser or device that sends us the GPC signal. If you are logged in, your preference will be associated with your account and if you log in from another device or browser, you will be automatically opted out. However, if you are not logged into your account, your request will only be associated with the browser you are currently using.
7. Right to Limit the Use and Disclosure of Sensitive Personal Information: Mercy Gaming does not collect sensitive personal information as that term is defined under California law.

10. Notice of Financial Incentive: As described above in the “How Information is Collected” section, we may offer referral programs or other incentivized data collection programs. For example, we may offer incentives to you such as discounts or promotional items or credit in connection with these programs, wherein you provide your Personal Information in exchange for a reward, or provide Personal Information regarding your friends or colleagues (such as their email address) and receive rewards when they sign up to use our Services. (The referred party may also receive rewards for signing up via your referral.) These programs are entirely voluntary and allow us to grow our business and provide additional benefits to you. The value of your data to us depends on how you ultimately use our Services, whereas the value of the referred party’s data to us depends on whether the referred party ultimately becomes a customer and uses our Services. 13. Authorized Agent: Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us as set forth in the “Contact Us” section below and provide written authorization signed by you and your designated agent. 4. Sensitive Data Inferences: We do not generally collect or share sensitive data (as that term is defined by Colorado law), nor draw inferences therefrom. In limited circumstances, to confirm eligibility for contests and competitions, we may collect information revealing citizenship or immigration status. We use this information strictly for eligibility verification and legal compliance purposes.
5. Right to Appeal: If we deny (or otherwise refuse to act) on your request to exercise your rights, you may appeal the denial within a reasonable period of time after you receive our decision. We will respond to your appeal within sixty (60) days of receiving it and provide you with a written explanation of the reasons for our decision. If the appeal is denied, we will inform you of how you may contact the Attorney General of Colorado should you want to submit a complaint.
Connecticut Data Privacy Act
